For Tobacco Industry

Tobacco industry is a good example which is highly regulated in most of the countries. On 3 April 2014, the European Parliament and the Council adopted the Tobacco Products Directive 2014/40/EU (TPD). The overall objective of the TPD is to approximate the laws, regulations and administrative provisions of the Member States concerning rules governing the manufacture, presentation and sale of tobacco and related products.

TPD aims to address illicit trade in tobacco products by introducing systems of traceability and security features for these products. The systems will contribute to reducing the circulation of tobacco products not compliant with the TPD and other tobacco control legislation. The systems will therefore play an important role in protecting public health, state budgets and legal economic operators.

The traceability system enables the movement of legal tobacco products to be monitored (tracking) and allows the public authorities to determine at which point a product was diverted into the illicit market, or vice versa (tracing).

Regulatory Compliance

UK (Dentsu)

The UK Tobacco Products (Traceability and Security Features) Regulations require the tracking and tracing of tobacco products manufactured in or imported into the United Kingdom (UK), from manufacturer/importer to distributor to point of sale. On 1 November 2021, HM Revenue and Customs (HMRC) appointed Dentsu Tracking, a specialised brand of Dentsu International Switzerland, as provider of the standalone UK Track & Trace system for tobacco products. The digital UK Track & Trace system enables the movement of legal tobacco products to be monitored (tracking) and allow the UK authorities to detect and fight the different forms of illicit trade. The Track & Trace system is an important pillar of the UK’s anti-illicit trade strategy as it enables HMRC to further reduce the circulation of non-compliant tobacco products which have not had the correct duty paid and do not meet all legal requirements in terms of content and packaging. Reducing the circulation of non-compliant tobacco products will also protect public health and support legitimate businesses operating in the UK. The system also enables the UK to comply with the WHO FCTC Illicit Trade Protocol (notably Article 8).

EU TPD2

Having regard to Directive 2014/40/EU of the European Parliament and of the Council of 3 April 2014 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco and related products and repealing Directive 2001/37/EC (1). In order to address the issue of illicit trade in tobacco products, Directive 2014/40/EU provides that all unit packets of tobacco products are to be marked with a unique identifier in order for their movements to be recorded. This will enable such products to be tracked and traced throughout the Union.

KSA, UAE (DeLaRue)

The General Authority of Zakat and Tax (GAZT) in The Kingdom of Saudi Arabia (KSA) agreed with DeLaRue to implement and operate a digital tax stamp solution for all tobacco products and soft drinks sold in the Kingdom. Under the agreement, De La Rue implemented its DLR Certify™ digital system to track and trace excisable products, starting with cigarettes. United Arab Emirates (UAE) also implemented same Track & Trace solution. Both countries comply with the World Health Organisation’s Framework Convention for Tobacco Control.

Bahrain, Qatar, Oman (DeLaRue)

Following KSA & UAE, other Gulf countries such as Bahrain, Qatar and Oman, have implemented Trcak&Trace systems to fight against illicit trade in domestic tobacco market.

Jordan, Burkina Faso (Inexto Inextrack)

In 2018, amendments to the Jordanian Customs Bylaw were made resulting in more stringent fines and penalties for smugglers of illicit products, including tobacco. Jordan takes actions to combat illicit trade, such as implementing track-and-trace systems (e.g. digital stamps) to follow tobacco products through the supply chain from production and import, to sale to consumers.

CRPT OMS (Russian Federation)

Russia chose to establish a publicprivate partnership to create its national track & trace system. CRPT OMS (CRPT - Advanced Technology Development Center in Russia, OMS - Order Management Station) is the Russian track and trace system that provides crypto codes upon request from manufacturers producing pharmaceutical products to the Russian market. The encrypted Data Matrix code was chosen for labelling goods in Russia. This unique digital passport can be assigned to goods both at the factory and upon import.
