The problem
Tobacco is a tightly regulated example in most countries. On 3 April 2014 the European Parliament and the Council adopted the Tobacco Products Directive 2014/40/EU (TPD). Its overall objective is to approximate the laws, regulations and administrative provisions of the Member States on the manufacture, presentation and sale of tobacco and related products.
TPD addresses illicit trade by introducing traceability and security features. The systems reduce the circulation of tobacco products that do not comply with the TPD and other tobacco-control legislation, and they protect public health, state budgets and legal economic operators. Tracking follows the movement of legal products. Tracing lets public authorities see at which point a product was diverted into the illicit market, or the reverse.

The published knowledge of tobacco trace requirements covers EU TPD2, Central Asia OMS, and the KSA and UAE De La Rue regimes.
Known compliance scope
- 01
EU TPD2
Directive 2014/40/EU repeals Directive 2001/37/EC. To address illicit trade, all unit packets of tobacco products are marked with a unique identifier so their movements are recorded and the products can be tracked and traced throughout the Union.
- 02
United Kingdom
The UK Tobacco Products (Traceability and Security Features) Regulations require tobacco manufactured in or imported into the United Kingdom to be tracked from manufacturer or importer to distributor to the point of sale. On 1 November 2021 HMRC appointed Dentsu Tracking as provider of the standalone UK Track & Trace system. The system monitors legal product movement, detects forms of illicit trade, and reduces circulation of products that have not had the correct duty paid or do not meet content and packaging rules. It is also part of UK compliance with Article 8 of the WHO FCTC Illicit Trade Protocol.
- 03
KSA and UAE
The General Authority of Zakat and Tax (GAZT) in Saudi Arabia agreed with De La Rue to implement and operate a digital tax stamp for tobacco products and soft drinks sold in the Kingdom. De La Rue implemented DLR Certify to track and trace excisable products, starting with cigarettes. The United Arab Emirates implemented the same Track & Trace solution. Both countries comply with the WHO Framework Convention on Tobacco Control.
- 04
Bahrain, Qatar, Oman
Following KSA and the UAE, Bahrain, Qatar and Oman implemented Track & Trace systems against illicit trade in the domestic tobacco market.
- 05
Jordan and Burkina Faso
In 2018, amendments to the Jordanian Customs Bylaw brought stricter fines for smugglers of illicit products, including tobacco. Jordan uses track-and-trace, such as digital stamps, to follow tobacco from production and import to sale. The published system name is Inexto Inextrack. Burkina Faso is named in the same scope.
- 06
Central Asia OMS
National track and trace systems in the region were established as public-private partnerships. The OMS — Order Management Station — provides crypto codes on request from manufacturers producing pharmaceutical products for these markets. The label is an encrypted Data Matrix. That digital passport is assigned at the factory or on import.
